Terms and Conditions

  1. Interpretation & Definitions
    1. The definitions and rules of interpretation in this condition apply in these terms and conditions.
      Booking: a booking made by the Client with Live India LTD as set out on the Booking Form.
      Booking Form: the booking form produced by Live India LTD to be completed by the Client upon making a Booking.
      Agreement: This document forms the agreement between the Client and Live India LTD under which the Services are to be provided by Live India LTD to the Client.
      Client: the person, firm or company who makes a Booking with Live India LTD. All individuals to whom the Services are provided by Live India LTD must be a minimum age of 18.
      Deposit: An amount of £500 or £2500 (for Bhutan Tour) as part of the Fee.
      Fee: The full amount payable by the Client under the agreement.
      Force Majeure: any act, event, omission or circumstance by beyond Live India LTD's reasonable control, including (without limitation) industrial disputes (whether involving the workforce of Live India LTD or any other party), failure of a utility service or transport network, act of God, labour disturbance, sabotage, failure of suppliers of materials, act of the public enemy, war, invasion, insurrection, riot, fire, storm, flood, ice, earthquake, explosion, epidemic, breakage or accident to machinery or equipment, or any other causes beyond Live India LTD's reasonable control including any, curtailment, order, regulation, or restriction imposed by an emergency circumstance not limited to those listed above.
      Fundamental Change: A change in the date, location or over 50% of the content of the Services.
      Recordings: Photographs, videos or any other audiovisual recordings taken of the Clients during the provision of the Services.
      Services: the services provided by Live India LTD to the Client under the terms of the agreement and "Service" shall be construed accordingly.
    2. Wording importing the singular meaning shall include the plural meaning and vice versa.
    3. Reference to any gender includes the other genders;
    4. Headings in these Conditions shall not affect their interpretation.
    5. A reference to a statute or statutory provision is a reference to it as it is in force for the time being, taking account of any amendment, extension, or re-enactment and includes any subordinate legislation for the time being in force made under it.
  2. General
    1. These Conditions shall be deemed to be incorporated in all agreements and in the case of inconsistency with any Booking Form or other form of communication between the Client and Live India LTD, whatever may be their respective dates, the provisions of these Conditions shall prevail unless expressly varied in writing and signed on behalf of Live India LTD.
    2. Any concession allowed by Live India LTD to the Client shall not affect the rights of Live India LTD under the agreement. If in any particular case any of these Conditions shall be held to be invalid or shall not apply to the agreement, the other Conditions shall continue in full force and effect.
  3. Booking
    1. In order to place a Booking, the Client shall submit a completed Booking Form to Live India LTD together with the deposit of £500 or £2500 (for Bhutan Tour). All Bookings shall be provisional and shall only be confirmed once the deposit has cleared in Live India LTD's bank account. If the Client is an individual, he or she must state his or her date of birth on the Booking Form and if the Client is an individual, a firm or a company making a Booking on behalf of more than one person, the date of birth of each person to whom the Services will be provided must be stated on the Booking Form.
    2. If a Booking is made by a Client, the Client shall be deemed to have read these Conditions and if the Booking is made by telephone, e-mail or facsimile, the Client is deemed to have signed the declaration on the Booking Form.
  4. Acceptance
    1. An agreement shall be formed when Live India LTD accepts the Booking in writing and Live India LTD reserves the right to decline any Booking at its discretion. Furthermore, no Booking will be accepted by Live India LTD if a Client, who is an individual, is under the age of 18, or where the Client is a firm or company, if anyone on whose behalf the Client is making the Booking, is under the age of 18.
    2. No variation of these Conditions shall be valid unless it is in writing and signed by or on behalf of Live India LTD and the Client.
    3. No verbal representations made by Live India LTD or any of its agents or suppliers shall be relied upon by the Client.
    4. Any quotations that may be given by Live India LTD are given on the basis that no agreement shall come into existence except in accordance with condition 4.1.
  5. The Fee and Payment Terms
    1. The Fee payable for the Services shall unless otherwise stated in the agreement be the fee chargeable by Live India LTD for such Services current at the date of the provision of the Services. Such Fee shall include the planning, organising and delivery of the Services.
    2. Once the deposit has been paid by the Client, and the agreement formed under condition 4.1, if the Client wishes to alter any aspect of the Services, Live India LTD may make such additional reasonable charges (Charges) as it may in its absolute discretion to decide and such Charges shall be notified in writing to the Client. If the Client refuses to pay such Charges, Live India LTD shall be entitled to cancel the agreement forthwith and notwithstanding condition 9, the cancellation charges set out in condition 8 shall apply.
    3. The balance of the Fee shall be paid by the Client to Live India LTD by no later than eight weeks prior to the commencement of the Services unless agreed otherwise in writing by Live India LTD on confirmation of the Booking in accordance with condition 4.1. If the Client fails to pay the balance of the Fee to Live India LTD, then Live India LTD may in its absolute discretion cancel the Booking and notwithstanding condition 9, shall be entitled to retain the deposit.
    4. The Fee must be paid in its entirety at the time of the Client placing a Booking in accordance with condition 3.1, if a Booking is made within eight weeks of the commencement of the Services.
    5. A 4% charge applies for Paypal payments and a 2% charge for credit card payments. Payments by bank transfer or cheque do not accrue any transaction charges.
  6. Responsibilities of the Client
    1. The Fee shall not include travel to and from the location at which the Services shall be provided and this shall be the sole responsibility of the Client unless agreed in writing with Live India LTD.
    2. The Client shall be responsible for their own personal medical requirements, clothing and footwear for the duration of the Services unless otherwise agreed in writing with Live India LTD.
    3. The Client shall be responsible for advising Live India LTD in the Booking Form of any health issues that may make them unable to take part in any of the Services. Failure to do so may result in Live India LTD terminating the agreement without refund and/or withdrawing the Client from any part of the Services, notwithstanding the provisions of condition 9.
  7. Changes to the agreement
    1. Live India LTD reserves the right to change any price or other particulars of the Services before the agreement is formed in accordance with condition 4.1.
    2. If there is a Fundamental Change to a confirmed booking Live India LTD will inform the Client as soon as is reasonably practicable and offer the Client the choice of accepting the change, receiving a full refund or accepting the provision of the Services on an alternative date.
    3. If there is any change other than a Fundamental Change after the agreement is formed in accordance with condition 4.1, Live India LTD is not obliged to inform the Client in advance and no compensation will be payable.
  8. Cancellations by the Client
    1. If the Client wishes to cancel the agreement, the Client must advise Live India LTD in writing as soon as reasonably practicable and the following cancellation charges shall apply:

      More than 16 Weeks before start of the services 30% of the Fee
    2. The cancellation charges are calculated inclusive of the deposit which is in all circumstances non-refundable.
    3. The cancellation charges may be waived in exceptional circumstances at the absolute discretion of Live India LTD.
    4. If the Client fails to arrive on the commencement date of the Services, the Fee will be due in full to Live India LTD and no refund shall be given.
    5. The Client may request to reschedule the Services, provided that they do so no later than 8 weeks before the commencement of the Services, save that Live India LTD reserves the right to refuse any such request. If Live India LTD agrees to reschedule the Services then an additional 15% handling fee will be payable by the Client. If the Client fails to pay the handling fee, then Live India LTD may in its absolute discretion cancel the agreement and notwithstanding condition 9, the cancellation charges in condition 8.1 shall apply.
  9. Cancellations by Live India LTD
    Live India LTD reserves the right to cancel an agreement but will endeavour not to do so. If Live India LTD cancels a Booking prior to the commencement of the Services, Live India LTD shall offer the Client the choice of either a full refund or the provision of Services on an alternative date (with pro-rata price reductions/increases as appropriate). A postponement of Services due to a  Force Majeure event does not consititute a cancellation by Live India LTD and alternative dates will be made available to the Client (with pro-rata price reductions/increases as appropriate) at the earliest reasonable opportunity. 
  10. Services
    1. Live India LTD reserves the right to alter the content of the Services without notice to the Client.
    2. Any Services published by Live India LTD are designed for illustrative purposes only.
    3. During the provision of the Services, Live India LTD reserves the right to alter the content of the Services at any time due to certain factors including but not limited to the weather and the physical fitness of the Clients.
    4. If a Client chooses not to participate in any part of the Services being provided, Live India LTD is not obliged to provide an alternative or any refund to the Client.
    5. Live India LTD may in its absolute discretion make decisions affecting the Clients and it may require a Client to cease participating in the Services if, for example, it believes that a person's health is at risk and if the Client has failed to advise Live India LTD of a health condition in accordance with condition 6.3, Live India LTD may in its absolute discretion terminate the agreement forthwith without refund, notwithstanding the provisions of condition 9.
    6. The Client must refrain from any illegal act and conduct which may give offence or cause danger or damage to any person or property at all times during the Services. If Live India LTD or any of its employees, consultants or agents, believe that the Client is in breach of this obligation or is likely to breach this obligation, Live India LTD may in its absolute discretion terminate the agreement forthwith without refund, notwithstanding the provisions of condition 9, and require the Client to leave the holiday group. Live India LTD will have no liability to the Client in respect of such termination, howsoever arising.
  11. Complaints
    If there is a problem during the holiday, the Client must report it in the first instance to an employee or consultant of Live India LTD. In the unlikely event that a problem cannot be resolved, the Client must notify Live India LTD within 28 days of the end of the Services advising Live India LTD of the full details of the complaint (Notice). Failure to serve the Notice on Live India LTD within the specified period will preclude the Client from being entitled to take any further action against Live India LTD.
  12. Limitation of Liability
    1. This condition 12 sets out the entire financial liability of Live India LTD (including any liability for the acts or omissions of its employees, agents, consultants, and Live India LTD contractors) to the Client in respect of:
      1. any breach of the agreement;
      2. any representation, statement or tortuous act or omission (including negligence) arising under or in connection with the agreement.
    2. All warranties, conditions and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded from the agreement.
    3. Nothing in these Conditions limits or excludes the liability of Live India LTD for death or personal injury resulting from the negligence of Live India LTD; or for any liability incurred as a result of fraud or fraudulent misrepresentation by Live India LTD.
    4. The Client recognises that engaging in the Services includes an inherent risk. Those risks include a broad range and the Client recognises that those risks include the possibility of personal injuries and even death. The Client chooses to participate in the Services in spite of those risks. The Client therefore agrees to assume all risks that may occur resulting in any harm, damage, injury, illness or death to oneself. The Client agrees to release and discharge Live India LTD, its officers, employees, consultants and agents from any and all claims for liability, damage, injury, illness, death, costs or other expenses or any other damages claimed except in respect of personal injury or death caused by the negligence of Live India LTD.
    5. Live India LTD will not accept liability for any loss or damage to any personal property belonging to the Client during the holiday. Live India recommends that you do not bring with you any items of expensive clothing that you would not like to see ruined. Clothes washing facilities are unpredictable and cannot be guaranteed to return the washed item in good condition. Live India also recommends that you do not bring expensive electronic equipment such as laptops which will receive a good shaking due to the potholed nature of the roads as well as exposure to dust.
  13. Assignment
    1. Subject at all times to condition 13.2, the agreement may be assigned by the Client to a third party.
    2. If the Client wishes to assign the agreement to a third party, he or she must give prior notice in writing to Live India LTD by no later than 8 weeks prior to the commencement of the Services, giving the full name and address of the third party and Live India LTD shall advise the Client as soon as reasonably practicable in writing whether or not it consents to the assignment to the third party. Live India LTD reserves the right to refuse an assignment to a third party at any time, without providing a reason for such refusal. If the Client subsequently has to cancel the agreement as a result of Live India LTD refusing the assignment to a third party, then the cancellation charges in condition 8 shall apply.
    3. Live India LTD may assign its rights under the agreement to any third party without obtaining the prior consent of the Client.
  14. Media
    1. Live India LTD will take recordings of the Client during the holiday and the Client accepts that all rights whatsoever and howsoever arising in the Recordings shall be owned solely by Live India LTD.
    2. Live India LTD may use any Recordings in any manner that it may in its absolute discretion decide including but not limited to its website or any other promotional material or advertisement, unless otherwise indicated by the Client.
  15. Law and Jurisdiction
    This agreement shall be construed in accordance with the laws of England. and shall have exclusive jurisdiction in relation to any matters arising out of these terms and conditions.
    These Terms and Conditions are governed by and construed in accordance with English Law. Any dispute arising in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the English Courts.
  16. Protective clothing
    We require that protective clothing and helmet is worn on the motorcycle at all times during the holiday.
  17. Medical conditions and disabilities
    If you or any member of your party have any medical problem or disability which may affect your holiday, please tell us before you confirm your booking so that we can advise as to the suitability of the chosen arrangements. In any event, you must give us full details in writing at the time of booking. If we reasonably feel unable to properly accommodate the particular needs of the person concerned, we must reserve the right to decline the booking or, if full details are not given at the time of booking, cancel when we become aware of these details in which case the cancellation charges in condition 8 apply.
  18. Carriers
    Carriage by air is subject to the terms and conditions of the carriers with whom you are traveling and to international conventions. Live India LTD accepts no liability whatsoever for cancellations, strikes, timetable changes, diversions, technical issues unrelated to Live India LTD, lost or mislaid luggage, or delays which result from any operational decision of the carrier concerned. Live India LTD accepts no liability for death, injury or illness that derives from carriage by air.
  19. Clients Miscellaneous Responsibilities
    You must ensure that your travel documents, passports, visas and vaccination certificates are in order and ensure that you have taken the advice of your GP with regard to inoculations or any other relevant medication. Live India must be notified of any health issues which may detrimentally affect you on the tour. In respect of a pre-existing medical condition you must inform your travel insurance company of this when you purchase your policy and ensure that you receive written confirmation from them that the condition is covered. Please ensure that you take this written confirmation with you in addition to the insurance policy, failure to do so may result in any associated claims being refused by the insurance company and may mean that we are unable to accept you on the tour. Live India will offer general advice but cannot be held responsible if you do not comply with current requirements before your departure. Live India does not accept liability for any advice given of a general nature prior to the holiday commencing. You are responsible for a timely check in for all flights and for presenting yourself to take up all pre-booked components of your holiday. No credit or refund will be given to you should you fail to take up any component of your holiday or if you lose any travel documents.

    A copy of the client(s) full motorcycle licence valid for the duration of the holiday as well as a copy of international motorcycle insurance covering medical repatriation if necessary must be provided with the booking form at the time of booking or prior to departure. Failure to do so will result in the immediate cancellation of the clients holiday without refund.
  20. Force Majeure
    Live India LTD shall not be considered to be in default or breach of this Agreement and shall be excused from performance or liability for damages to any other party, if and to the extent it shall be delayed in or prevented from carrying out any of the provisions of this Agreement, arising out of or any act, omission, or circumstance by or in consequence of any Force Majeure as described but not limited to those included in 1.1. A Force Majeure event does not include an act of negligence or Intentional Wrongdoing by Live India LTD. When a Force Majeure event is claimed, Live India LTD shall use reasonable diligence to remove the condition that prevents performance and both Client(s) and LiveIndia LTD shall not be entitled to suspend performance of it's obligations in any greater scope or for any longer duration than is required by the Force Majeure event. Live India LTD shall use it's best efforts to mtiigate the effects of such Force Majeure event, remedy its inability to perform, and resume full performance of its obligations hereunder as soon as is reasonably possible.
  21. Minor accident excess
    In the unlikely event of a minor accident where property or livestock is damaged, the custom in India is for reparation to be made at the roadside. For that reason we require the client to carry with them the amount of £200 or equivalent for the duration of the holiday. Should such an event occur then the Live India guides will carry out the negotiations on behalf of the client to the satisfaction of both parties in order to avoid undue stress and upset to each. This payment is non redeemable through the clients insurance policy and renders further claims for that event invalid. Therefore it is a discretionary payment depending on the situation as it arises.
  22. Unused Services
    No refund will be due to you in respect of non-utilisation of any part of the travel arrangements made for you.
  23. Insurance
    We cannot stress enough the importance of taking out adequate holiday insurance against cancellation charges, unexpected curtailment of your holiday, medical expenses arising overseas, loss or damage to luggage and personal liability claims against you. Should you elect not to effect suitable travel insurance cover despite this advice, then you undertake on behalf of yourselves and all members of your party to indemnify both ourselves and our overseas agents and representatives (as applicable) against any costs that arise which would otherwise have been met had such insurance cover been taken out.

    You are not required to take out insurance for the motorcycle itself which is fully comprehensively insured, but If a motorcycle is damaged willfully you will be liable for the cost of repair.

    Live India LTD accepts no liability for the provision of services from our suggested medical and travel insurance provider. It is the clients responsibility to read the insurers terms and conditions themselves and decide whether or not to accept them. Any claims must be made directly to the insurers by the insured. Live India cannot act as an intermediary in this regard.
  24. Data Protection
    The following applies to any information you provide to us, for example during any registration or ordering or confirmation of details process:

    You authorise us to use, store or otherwise process any personal information which relates to and identifies you, including but not limited to your name and address, to the extent reasonably necessary to provide the Services which are available through our Web Site by us or our sub-contractors. Unless you have indicated otherwise your personal details will be included on a database compiled for Live India's use only. We do not pass your information to third parties and will only use your information to contact you from time to time regarding new routes or offers we have available. You must ensure that the Personal Information you provide is accurate and complete and that all ordering or contact details contain your correct name, e-mail address and other requested details. For more information about how we deal with your Personal Information, please read our Privacy Statement. You acknowledge and agree to be bound by the terms of our Privacy Statement.

    By accepting the Agreement, you agree to the processing and disclosure of the Personal Information for the provision of the Services. If you would like to review or modify any part of your Personal Information or you have not indicated that you do not wish to receive Live India’s marketing material, but if change your mind about this you should notify andrew@liveindia.co.uk. As soon after this as is reasonably practicable, we will remove your name from the information database.
Privacy Statement

Any personal information you give to us will always be processed in accordance with the UK Data Protection Act 1998. We will only use the personal information you provide to deliver the services you have requested, or for our lawful, disclosed purposes. We will not make your personal details available outside our organisation without your consent, unless obliged by law.

This website will automatically track certain information about you in the course of you using this website, such as your IP address and browser identification. This information is used only for system administration and for providing statistics to evaluate use of this site. We do not use cookies for collecting personal information from this site. (A cookie is a small amount of data that is sent to your browser from a web server and stored on your computer's hard drive.)

  3. Intellectual Property Rights
    Unless otherwise stated, the copyright and other intellectual property rights in all materials on the Website (including without limitation, photographs and graphical images) are owned by the Live India LTD or its licensors.
  4. Access to the Website
    Live India LTD shall use its best endeavours to ensure that the Website is available 24 hours a day, 7 days a week. However Live India LTD will not be liable if for any reason the Website is unavailable at any time for any period.
    In the event of system failure, maintenance or repair or for reasons beyond the control of Live India LTD access to the Website may be temporarily suspended.
  5. Visitor conduct and material
    With the exception of personal data, which is covered under the Privacy Policy, if you transmit or post any information to this Website it will be considered to be non-confidential and non-proprietary. Live India LTD will have no obligations with respect to this information and will be free to copy, disclose, incorporate and otherwise use such material and all data, images, sounds, text and other things embodied therein for any and all commercial and non-commercial purposes.

    Live India LTD will co-operate fully with any law enforcement authority or court order requesting or directing the Live India LTD to disclose the identity of anyone posting any material in breach of paragraphs 4.2 and 4.3.
    In the event that your use of material contained on the Website results in the need for servicing, repair or correction of equipment, software or data, you assume all costs thereof.

    In the event that a third party has accessed the Website without authorisation and altered any of the content of the Website, Live India LTD shall not be liable for any damage or loss resulting from the unauthorised access, alteration or modification to the Website.

    The Website contains links to other websites and these are provided solely for your convenience. Live India LTD has not reviewed all of these websites and does not control and cannot take responsibility for the content and availability of these third party websites. Live India LTD therefore, does not endorse or make any representation regarding the material on these third party websites. If you access any of the third party websites, you will be leaving this Website and you access the third party website entirely at your own risk.
    You may create a link to this Website on the basis that you link to, but do not replicate, the home page of the Website. Your right to link to the Website is subject to the following conditions:

    Live India LTD will endeavour to ensure that the information on the Website is correct. Live India LTD does not warrant the accuracy and completeness of the material on the Website. Live India LTD may make changes to the material on the Website, or to products, services or prices described in it, at any time without notice.
